Terms of Service

1. Scope

These Terms of Service ("Terms") govern the contractual relationship between Vizorah.ai, operated by Muhammad Saad Ali (sole proprietor) ("we," "our," or "the Service"), an AI-powered architectural visualization platform, and its users ("you" or "Customer"). Any deviations from these Terms require our explicit written agreement.

2. Service Overview

Vizorah.ai provides AI-driven architectural visualization services. Our platform enables users to generate architectural imagery—including interiors, exteriors, elevations, and aerial views—using artificial intelligence. Access to the Service is provided through subscription-based plans or other offerings we may introduce.

3. Subscription and Payment

3.1 Subscription Fees

Customers agree to pay the applicable subscription fee according to their chosen plan. Subscription fees are billed automatically in advance via our designated payment processor (Paddle, our Merchant of Record). Pricing is as published on our website at the time of subscription.

3.2 Payment Obligations

Customers are responsible for ensuring that their payment details are accurate and kept up to date. Failure to make timely payments may result in suspension or termination of access to the Service.

3.3 Taxes

All fees are exclusive of applicable taxes. Any statutory taxes (e.g., VAT, sales tax) will be added to the invoice amount in accordance with the laws of the customer's location.

4. Subscription Duration and Cancellation

4.1 Contract Term

Subscriptions are offered on a monthly or annual basis and automatically renew at the end of each billing cycle unless canceled in advance.

4.2 Cancellation

You may cancel your subscription at any time before the start of the next billing cycle. Cancellation is effective at the end of the current billing period. Subscriptions cannot be canceled mid-cycle for a refund.

• Using the cancellation option within your Vizorah.ai account dashboard
• Contacting us via email at support@vizorah.ai

5. Refund Policy

5.1 Non-Refundable Service

Due to the immediate access provided to digital services, all subscription payments are final and non-refundable.

5.2 Plan Changes

• Upgrades: Customers may upgrade to a higher-tier plan at any time. Additional charges will be billed on a pro-rated basis.
• Downgrades: Downgrades take effect at the next billing cycle. No refunds are issued for downgrades.

5.3 Annual Discounts

Annual subscriptions are offered at discounted rates compared to monthly subscriptions. By subscribing annually, you commit to the full term. No early cancellation refunds are provided.

6. Default and Late Payments

In cases of failed or late payments, Vizorah.ai reserves the right to suspend or terminate your access to the Service. You are responsible for any additional fees, interest, or collection costs associated with overdue payments.

7. Content Ownership and Rights of Use

7.1 Ownership

You retain ownership of all content you create using Vizorah.ai. We do not claim ownership of your generated images, prompts, or related materials.

7.2 License to Use

By using the Service, you grant Vizorah.ai a limited, non-exclusive license to process and store your content solely for the purpose of delivering the Service.

7.3 Publication Rights

Unless content is submitted to the Community Gallery (see Section 9), Vizorah.ai will not use your content for marketing, research, or display without your explicit permission.

8. Content During Open Beta

8.1 Non-Private Content

During the Open Beta phase, all content uploaded or generated may be visible to other beta users or used by Vizorah.ai for testing and demonstration purposes.

8.2 Removal Rights

You may request removal of beta content from public display by contacting support. We will process such requests promptly.

8.3 Transition to Launch

After the public launch, new content will be private by default, subject to the privacy protections outlined in our Privacy Policy.

9. Community Submissions

9.1 Opt-In Sharing

Users may choose to share content with the Vizorah.ai Community Gallery. By submitting content, you grant Vizorah.ai and other users a worldwide, non-exclusive, royalty-free license to:

• Display your content in the Community Gallery
• Allow other users to view, like, and attempt to replicate your results

9.2 Marketing Use

Community-submitted content may be used for marketing purposes, such as social media, website showcases, or email campaigns. If you do not wish your content to be used for such purposes, you may opt out via your account settings.

9.3 Revocation

You may remove your content from the Community Gallery at any time. However, this does not retroactively revoke rights for copies already accessed or replicated by other users.

10. Intellectual Property of Vizorah.ai

All technology, models, algorithms, designs, and software used to provide the Service remain the exclusive intellectual property of Vizorah.ai and its licensors. Customers may not copy, reverse-engineer, or redistribute the platform or its components.

11. Compliance with Open-Source Licenses

Vizorah.ai incorporates certain open-source technologies, including Stable Diffusion and ControlNet, under their respective licenses. We comply with the requirements of these licenses and expect users to do the same.

12. Privacy and Data Protection

Vizorah.ai is committed to compliance with GDPR and extends equivalent data protection rights to all users globally.

We collect and process personal data (e.g., name, email, onboarding questions) solely to operate user accounts, deliver the Service, process billing, and—where explicitly opted in—send newsletters.

You may unsubscribe from marketing emails at any time. Server logs, cookies, Google Analytics, and Google Tag Manager may be used for platform improvement and performance monitoring. For details, please see our Privacy Policy.

13. Amendments to Terms

We reserve the right to update these Terms. Changes will be communicated via email or notice within the platform. Continued use of the Service after updates constitutes acceptance.

14. Jurisdiction and Governing Law

These Terms are governed by internationally recognized commercial principles and applicable data protection laws (including GDPR). While Vizorah.ai is based in Pakistan and operated by Muhammad Saad Ali, we extend the same standards globally. Disputes shall be resolved under the competent courts of Pakistan, unless mandatory laws in your country of residence provide otherwise.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
